In South Africa, your will ensures your assets are distributed according to your wishes.
Here’s a quick overview of the different types:
Testamentary Will
The most common type. It outlines how your assets should be distributed after your death and must comply with the Wills Act.
Living Will
This relates to your medical care, not your assets. It lets you express your wishes about life-sustaining treatment if you become unable to communicate.
Joint Will
A single will created by two people, usually spouses, to express shared wishes for asset distribution. It can become complex if one partner dies or the couple separates.
Mutual Will
Two individual wills with matching terms. Each person agrees to leave their estate to the other and outlines what happens after both have passed.
Holographic Will
A handwritten and signed will that does not require witnesses. It is legal but must still meet specific requirements to be valid.
